Minimum Business Standards
Our Minimum Business Standards were developed to promote a safe, respectful, and positive experience for every user of the VeloRide App, including both riders and drivers. These Minimum Business Standards apply to all users of the VeloRide App and failure to engage in appropriate and respectful behavior while utilizing the VeloRide App may be considered a material breach of the terms of the Agreement entered with VeloRide and lead to loss of access to the VeloRide App.
Respect
Everyone who uses the VeloRide App deserves to be treated with respect. As a user of the VeloRide App, it is expected that you use good judgement and behave respectfully towards other users of the VeloRide App as well as employees of VeloRide. Failure to treat others with respect and courtesy may lead to loss of access to the VeloRide App. Some examples of inappropriate or disrespectful behavior include, shouting, swearing, damaging the personal belongings of others, including damage to the vehicle, spilling food and/or drinks in the vehicle, and/or making inappropriate or offensive comments towards, about, or in the company of others. Inappropriate or offensive comments include, but are not limited to, personal questions relating to an individuals’ sexual orientation or preference, relationship status, physical appearance, sexually explicit or suggestive comments, gestures, or displays, and an individuals’ race, religion, or political beliefs.
If you damage property, you are responsible for the cost of cleaning and repair fess, outside of normal wear and tear.
No Physical Touch or Threats
You should not physically touch strangers in the vehicle or that you met while using the VeloRide App. Limited exception may apply to persons needing or requesting physical assistance. Any physical violence or threat of physical violence is considered a material breach of the terms of the Agreement and will result in loss of access to the VeloRide App.
No Unwanted Contact or Communication
Once a transportation request is complete, the parties should not contact each other, unless the contact is consensual. Unwanted post-transportation communication or contact may be considered harassment or, at times, stalking. Do not try to visit and/or contact a rider or driver after the conclusion of the ride, unless both parties explicitly and consensually agree to such contact.
Intoxicating Substance Policy
Drug use and open containers of alcohol are never allowed while using the VeloRide App.
In accordance with Section 2402.106 of the Texas Occupations Code, while logged in to the VeloRide App, drivers are prohibited from “any amount of intoxication.” If a rider believes that a driver may be intoxicated, the rider should ask the driver to end the trip immediately. Then exit the vehicle and call 911. Use the App to request a new ride. Once you have left the vehicle, please also report your experience to _support@veloride.us and/or the chat feature in the App. If a driver is suspected of being intoxicated, VeloRide is required, by law, to conduct an investigation into the reported incident and “immediately suspend the driver’s access to” VeloRide while the investigation is pending.
If a driver encounters a rider who is too drunk or rowdy, the driver has the right to decline the trip for the driver’s own safety.
Firearms Ban
Riders and their guests, as well as drivers, are prohibited from carrying firearms while using the VeloRide App, to the extent permitted by applicable law.
Compliance With The Law
All users of the VeloRide App are expected to comply with all applicable laws, regulations, and ordinances. Violation of applicable laws, regulations, and ordinances may lead to loss of access to the VeloRide App. Everyone is responsible for knowing and obeying all applicable laws, including airport rules and regulations when at the airport, and the rules of the road—including complying with traffic laws, signs, and signals—at all times when using the VeloRide App.
Drivers and riders must comply with applicable laws when traveling with infants and small children. Where use of a car seat is required by law, it’s the rider’s responsibility to provide and fit a suitable car seat, unless our local guidelines, terms, or other policies say otherwise. Children age 12 and under should travel in the back seat.
All relevant licenses, permits, and any other legal documents required of drivers and delivery people must be kept up to date. For example, all drivers and delivery people using a vehicle are required by law to maintain a valid driver’s license, insurance, and vehicle registration. For ridesharing, this also includes meeting the applicable regulatory requirements for rideshare or for hire drivers in your area. VeloRide reviews reports of crashes or traffic citations that may have happened during a trip, and other reports, including but not limited to those that may indicate poor, unsafe, or distracted driving. Local rules about parking may limit where drivers can park their vehicle when waiting for riders to arrive or to exit a vehicle. For example, stopping in bike lanes or blocking accessibility ramps may violate the law.
For riders, let your driver handle the driving. For example for riders, do not touch the steering wheel, and do not tamper with the gear shift or other knobs, buttons, or components that are used to operate a vehicle. For riders, do not ask a driver to speed or to make illegal stops, drop offs, or maneuvers.
Fraud
It is important to provide accurate information when reporting incidents, creating and accessing your VeloRide account, disputing charges or fees, and requesting credits. Only request fees or refunds that you are entitled to, and use offers and promotions only as intended. Do not knowingly complete invalid transactions.
Fraudulent activity may also include, but not be limited to: deliberately increasing the time or distance of a trip for fraudulent purposes or otherwise; accepting trip requests without the intention to complete, including provoking riders to cancel for fraudulent purposes; creating dummy accounts for fraudulent purposes; claiming fraudulent fees or charges, like false cleaning fees; intentionally requesting, accepting, or completing fraudulent or falsified trips; disputing charges for fraudulent or illegitimate reasons; creating improper duplicate accounts; or falsifying documents, records, or other data for fraudulent purposes.
No Discrimination
In accordance with Section 2402.112 of the Texas Occupations Code, while logged in to the VeloRide App, drivers are prohibited from:
- (1) discriminating on the basis of a passenger’s or potential passenger’s location or
destination, race, color, national origin, religious belief or affiliation, sex, disability,
or age; and - (2) refusing to provide service to a potential passenger with a service animal.
For the purposes of Subsection (1), “sex” means the physical condition of being male or female.
VeloRide and any driver using the VeloRide App, “may not impose an additional charge for transportation of individuals with physical disabilities because of those disabilities.”
Account Sharing
Account sharing is prohibited. To access the VeloRide App, each user must register and maintain an active account. For the safety of all users of the VeloRide App, do not let another individual use your account and never share your personal information used in connection with your account.
Individuals Under The Age of 18
You must be 18 years or older to have an account with VeloRide. No individual under the age of 18 may ride unaccompanied in a vehicle or maintain a VeloRide account. Account holders may not request a ride on behalf of someone under the age of 18.
Dashcams
Drivers may choose to install and use a dashcam while providing transportation services using the VeloRide App. The dashcam may be used to record rides and provide evidence to VeloRide, law enforcement, or insurance companies. Please check your local laws to understand your responsibilities and rights with respect to the use of dashcams.
Vehicles
Drivers are expected to keep their vehicles maintained and in good operating condition. This means maintaining their vehicle in accordance with industry safety and maintenance standards and monitoring for and repairing any parts that are recalled by the vehicle manufacturer.
In accordance with Section 2402.111 of the Texas Occupations Code, each driver must use a vehicle that meets the requirements of Chapter 548, Transportation Code, and has four doors, and a maximum passenger capacity of not more than eight people, including the driver.
Vehicles must also be in good working condition, have a clean interior, lack cosmetic damage to the inside and outside, be larger than a subcompact class, have a valid license plate, and not be more than ten years old. The vehicle may not display inappropriate verbiage or symbols that are visible in the interior or exterior of the vehicle.
Public Emergencies
VeloRide may take additional measures, including restricting access to the VeloRide App, to try to preserve the safety of the Platform during public emergencies, including, but not limited to, natural disasters, public health emergencies, and public crisis situations.
Use of Phones
Drivers should be familiar with and follow all State and local laws concerning all cellphone use and texting.
